Purpose. To provide students the opportunity to understand how to create an effective response to a Congressional Inquiry.
Requirements: a. The memorandum must be no more than one page. Letterhead: DEPARTMENT OF THE ARMY 369TH ADJUTANT GENERAL BATTALION 2306 MAGRUDER AVENUE FORT JACKSON, SC b. The draft response will be for your Battalion Commander’s review (LTC Patrick A. Lanier). c. The memorandum must be submitted in accordance with the assignment review cycle 3.
Situation: On 14 June 2020, PFC Kirk Palla submitted a concern to his Congressman (Congressman Dan Crenshaw: 1849 Kingwood Dr. Ste. 100 Kingwood, TX) regarding the denial of his request to take a four day pass over a normal weekend, to include Friday and Monday. He firmly believes that he deserves the pass because he has not received any disciplinary action since arriving to the unit one year ago. He has 75 days of accrued leave, and his commander, CPT John Rambo, denied his pass and told the Soldier to take leave instead. CPT Rambo’s response stated that since the Soldier has 75 days of accrued leave and there are only two months left prior to the end of the FY, he needed to use 20 more days of leave prior to the end of the FY. Paper For Above instruction
In responding to the congressional inquiry concerning PFC Kirk Palla's denied leave request, the memorandum must be concise, clear, and professional, adhering to the strict one-page limit and official letterhead requirements. The purpose of the response is to clarify the military policy or reasoning behind the denial, provide necessary context, and communicate the Army’s position effectively to the Congressman.
To begin, the response should acknowledge receipt of the concern, demonstrate respect for the Congressman’s role, and affirm the commitment of the Army to fairness and transparency. The memo should clarify that, according to AR 25-50 and HQDA Policy Notice 25-52, military leave policies are designed to balance operational readiness with individual needs. When a soldier has accrued significant leave days, such as 75 in this case, policies stipulate that leave should typically be used prior to fiscal year-end unless operational or regulatory constraints dictate otherwise.
The response should explain that the denial was made in accordance with established regulations. Specifically, the commanding officer, CPT Rambo, determined that, given the remaining two months before the fiscal year's end, the soldier was encouraged to utilize his accrued leave to prevent excessive carryover, which is the Army's standard practice to manage leave balances. The guidance indicates that the soldier needed to use 20 days of leave before the end of the fiscal year, which is consistent with the policy to limit excess leave carryover and promote leave utilization for health and morale benefits.
The memorandum must emphasize that operational requirements are always considered, but in this instance, the decision was made based on existing policies. It should also mention that if the soldier's request was for emergency or exceptional circumstances, those could be considered, but based on the information provided, the denial aligns with the applicable policies.
Finally, the response should convey the Army’s ongoing commitment to support soldiers’ welfare and fairness, and invite the Congressman to contact the unit for further clarification if needed. The tone should be respectful, professional, and concise, following the one-page limit strictly.
