Imagine yourself as a paralegal working in a law office that has been tasked with reviewing three current cases. You will review the case studies and compose a short report for each, applying your legal knowledge and understanding of the types of business organizations. In each of the three reports, you will focus on areas of law covered in this course.
Case Study One focuses on the legal system, criminal law, and ethics. Chris, Matt, and Ian, who live in California, decide to start an internet business selling an aftershave lotion called Funny Face. They contract with Novelty Now Inc., a Florida-based company, to manufacture and distribute the product. Chris frequently meets with a representative from Novelty Now to design the product and plan marketing strategies. To increase profit margins, Chris directs Novelty Now to substitute PYR, a low-cost chemical emulsifier that is not FDA approved, for the original formula.
Funny Face is marketed nationally via radio, newspapers, web, and Facebook. A CEO, Donald Margolin, purchases a bottle and after using it, his face turns blue. Margolin and his company sue Novelty Now and the three men, claiming negligence and seeking damages. It is discovered PYR caused the discoloration.
Each critical element below must be addressed:
A. Rules of Jurisdiction
Apply the rules of jurisdiction to determine appropriate courts for Margolin’s lawsuit, considering federal court, state court, and long-arm principles.
B. Alternative Dispute Resolution (ADR)
Analyze the advantages and disadvantages of two ADR types suitable for this case, defining each method.
C. ADR Preferences
Discuss which parties (Funny Face, Novelty Now, Margolin) would prefer each ADR type and why.
D. Criminal Liability of Corporations and Officers
Apply criminal law to determine if corporations or officers may be held liable for criminal acts in this scenario.
E. Potential Criminal Acts
Identify potential criminal acts by Funny Face and/or Novelty Now, based on classifications of crimes.
F. Criminal Liability of Specific Parties
If the use of PYR is criminal, discuss the criminal liability of Funny Face, Chris, Matt, Ian, and Novelty Now, supported by legal concepts.
G. Ethical Decision-Making
Evaluate the ethical issues using at least three guidelines of ethical decision-making, applying them to this case.
Your submission should be a three- to six-page Word document, double-spaced, in 12-point Times New Roman font, with one-inch margins. Use APA citations for sources.
