Generative AI products are only one manifestation of AI. Predictive AI systems are already used to determine who gets a mortgage, who gets hired, who gets admitted to college, and who gets medical treatment — but products like ChatGPT have brought AI to new levels of public engagement and awareness.
Can we make room for the best of what AI has to offer while also resisting its perils? In a world where decisions about our lives are increasingly informed by algorithmic decision-making, we cannot have racial justice if we adopt technical tools for the criminal legal system that only further incarcerate communities of color. We cannot have gender equality if we employ AI tools that use historic hiring data reflecting sexist practices to inform future candidate selections that disadvantage women and gender minorities. We cannot claim to advocate for disability rights and create AI-powered tools that erase the existence of people who are differently abled by adopting ableist design patterns.
Furthermore, we cannot uphold privacy rights if we allow AI-powered surveillance systems in schools or capitalism-driven surveillance that reduces children to data for sorting and tracking. If AI systems powering key societal sectors—education, healthcare, employment, housing—mask discrimination and entrench bias, we reinforce algorithmic injustice. These systems replace fallible human gatekeepers with machines seen as objective but that are equally flawed. When these machines fail, those with the least resources and limited access to power bear the worst outcomes. Power AI will not resolve poverty because the underlying societal conditions prioritizing profit over people are non-technical issues.
AI cannot solve discrimination because cultural biases rooted in gender, race, language, height, or wealth are societal, not technical problems. Similarly, AI cannot address climate change, which is driven by political and economic decisions exploiting earth’s resources. As Dr. Rumman Chowdhury emphasizes, outsourcing moral decisions to machines does not resolve social dilemmas. Historically, civic groups used the phrase “justice league” to fight for women’s suffrage, racial equality, and workers’ rights, serving as modern inspirations for resisting oppression. These justice-oriented organizations exemplify the belief that resistance to tyranny, oppression, and erasure is possible through pathways to liberation. My work with the Algorithmic Justice League follows this tradition, countering the misconception that machines are free from societal bias, based on my experiences illustrating otherwise.
Understanding the origins and organization of data is critical; without this knowledge, ethical considerations become opaque. Large AI systems contain billions or trillions of parameters, and decisions made by analyzing this data are not inherently neutral. “Neural does not equal neutral,” and automated decisions influencing opportunities and liberties require human oversight. If decisions about our lives are driven by these systems, we must have a voice and choice in their deployment. Neurotechnology exemplifies this, evidencing the potential for devices to tell us about our mental state, detect health conditions, or analyze cognitive patterns.
For instance, soon, neurotech devices like smart helmets could diagnose concussions immediately or monitor brain activity to predict conditions like Alzheimer’s or schizophrenia. In China, EEG sensors are already used by train drivers to ensure alertness, and factory workers are monitored for productivity and emotional well-being. Such surveillance raises profound ethical concerns about privacy and autonomy, especially considering that current laws, including the US Constitution, do not explicitly regulate brain data or neuroprivacy. As a legal scholar highlights, our sovereignty over our own brains is not yet protected from government or corporate intrusion. The potential for brain data to be exploited or hacked underscores urgent debates about rights, consent, and the future of cognitive liberty.
The accumulation and commodification of brain data threaten individual autonomy. Society must establish the right to cognitive liberty—the right to self-determination over mental processes—encompassing mental privacy, freedom of thought, and personal agency. This involves rethinking legal protections to prevent unauthorized access or sale of neural data and to ensure individuals’ control over their mental experiences. The intersection of emerging neurotechnologies and legal frameworks will shape our capacity to preserve mental sovereignty in the digital age.
