The school security guard takes the student to the principal’s office. The principal calls the local police. In the state where the school is located, it is illegal to carry a concealed weapon without a permit and all weapons are prohibited on campus. Officer Smith arrives at the school approximately 10 minutes later. Officer Smith takes a statement from the school security guard and searches the student’s backpack. He seizes the gun and places the student under arrest. Officer Smith then asks the student if he would like to make a statement to explain why he was carrying a concealed weapon on campus. The student replies, “What weapon? That’s not my backpack and I never saw that gun before.” The student is then transported to the local jail. However, on the way to the local jail, Officer Smith asks the student again why he brought a loaded gun on campus. The student admits that it was his gun and stated that he needed it for protection. Upon arrival at the jail, the student is booked. Six hours later, the student is interviewed by Detective Columbo. The detective reads the student his Miranda warning and asks if he would like to make a statement. The student replies, “No, I want a lawyer.”.

In your paper, examine the constitutional amendments relevant to this situation. Part 2: Arrest and Trial Scenario

Tyler, a well-known escort service provider in his community, is suspected of murdering an escort who worked for him. Police meet Tyler at the airport upon his return from Cancun and arrest him for his suspected involvement. However, they do not inform him of his rights or his right to counsel. They immediately begin questioning him, and he admits to knowing the victim and being with her the night of the murder. Tyler is then booked and charged with first-degree murder. He requests an attorney and a trial by jury but does not waive his right to a speedy trial.

In your paper, analyze the constitutional amendments that relate to this scenario. Describe four key elements of a lawful arrest and the proper procedures to ensure Tyler's rights to due process are protected. Part 3: Correctional Officers and Rights of Inmates

In the case of Hudson v. McMillian, the U.S. Supreme Court addressed issues of excessive force and cruel and unusual punishment under the Eighth Amendment. This case established the Hudson test (PANAM), a five-pronged framework for evaluating claims of excessive force involving inmates: (P)erceived threat by corrections officers; (A)ny efforts to de-escalate; (N)eed for force; (A)mount of force used; and (M)edical injuries sustained. You will watch a video scenario involving correctional staff and notes on the events and individuals involved.

Write a paper summarizing the scenario and assess whether the inmates' rights were violated by the officers involved. Examine applicable constitutional amendments and analyze whether the incident meets the five prongs of the Hudson test. Make recommendations for how the sergeant should address the officer’s conduct to ensure appropriate response and accountability.
