In advising Jeff Passmore on the hospital’s liability regarding the medication error, I recommend that the hospital be held liable based on the principles of negligence. The hospital arguably breached its duty of care by failing to implement adequate verification procedures to ensure the correct medication was administered, which directly contributed to the patient’s injury. The breach is evidenced by the failure to double-check the medication label and dosage, which a reasonable standard of care would require. Furthermore, the injury—adverse effects from the wrong medication—was verified through medical documentation and patient reports, establishing the injury as a direct consequence of the error. The causation link is apparent because the medication error was the proximate cause of the injury, and the hospital could foresee that neglecting proper verification processes might lead to patient harm. Given these factors, liability is supported, and the hospital must accept responsibility for the negligence that resulted in the medication error and subsequent injury.
