Crime's classification and prosecution depend on legal definitions, which vary across jurisdictions but generally aim to deter behavior harmful to individuals and society. The two most common models explaining how society determines criminal acts are the consensus model and the conflict model. The consensus model assumes that laws reflect a collective societal agreement on right and wrong, promoting social cohesion. Conversely, the conflict model suggests that laws are influenced by power dynamics and serve the interests of dominant groups, often reflecting economic or political motives (Siegel, 2018).

The government structure as it pertains to the criminal justice system comprises three branches: legislative, executive, and judicial. The legislative branch enacts laws, the executive enforces them through agencies like the police, and the judicial interprets laws and administers justice via courts.
