This paper examines two examples of advertising campaigns that arguably exceeded ethical boundaries, analyzing why their messages crossed the line and discussing the implications related to Section 13-2: Advertising as a Contract Basis for Product Liability.
One notable example of persuasive advertising that might have gone too far is the case of the 1990s tobacco advertising campaigns. For decades, tobacco companies employed persuasive messages implying that smoking was glamorous, sophisticated, or even harmless when, in fact, extensive scientific evidence proved the severe health risks involved. Advertisements featured celebrities and young models to create an aspirational image around smoking, which clearly targeted vulnerable populations, including youth. These ads often omitted or downplayed the addictive nature of nicotine and the catastrophic health consequences of smoking. These messages positioned the vehicles as eco-conscious choices aligned with consumer values regarding sustainability. However, it was later revealed that the company had installed software—often called "defeat devices"—that manipulated emissions data during testing to meet regulatory standards artificially. This deception misled consumers into believing they were purchasing a cleaner vehicle than it actually was, constituting an unfair and deceptive trade practice under the FTC’s guidelines. The emissions cheat not only violated legal standards but also betrayed consumer trust, illustrating how advertising that promises environmental benefits must be truthful. When companies exaggerate or fabricate features to persuade consumers, they cross into the realm of deception, particularly when such messages influence purchasing decisions based on false claims (FTC, 2016).
Both examples demonstrate critical boundaries that advertising messages should not cross. Effective persuasion involves presenting truthful, substantiated claims that support consumers in making informed decisions. When advertising inflates benefits, suppresses drawbacks, or intentionally misleads, it veers into unfair and deceptive practices, violating Section 13-2 of the FTC Act. Such violations not only harm consumers but also undermine fair competition within the marketplace. The FTC enforces regulations to curb these practices, ensuring that consumer trust is maintained and that advertising remains a truthful conduit of information rather than a tool for manipulation.
In conclusion, persuasive advertising becomes problematic when it distorts facts or conceals material information to influence consumer behavior unfairly. The tobacco advertising strategies of the past and the Volkswagen emissions scandal serve as cautionary examples where messages crossed ethical boundaries, falling into deceptive trade practices as defined by Section 13-2. For advertising to remain effective without becoming unfair or deceptive, it must be grounded in honesty and transparency, aligning with legal standards designed to protect both consumers and competition.
