This project requires you to reflect on, analyze, and apply tort law, product liability law, agency law, and contract law within a business context. You will identify and analyze legal issues, provide recommendations, and develop critical thinking skills through in-depth analysis. The project relates to course concepts covered in weeks 1-7 and involves referencing earlier course materials.

The scenario involves the GC owners consulting with TLG before launching their business operations. Your task is to identify areas of business law presenting significant risk and liability potential for GC and advise on legal vulnerabilities that may require legal counsel.

Part I. Risks and Liabilities

Analyze and discuss two (2) areas of business law that pose the greatest potential risks and liabilities for GC, choosing from the following options: negligence related to business operations; negligence related to premises liability; strict product liability concerning the use of EPI products; strict product liability related to resale of EPI products; contracts with employees; contracts for the sale of goods with clients; or agency law and contracts with GC agents. For each chosen area:

  • Provide a detailed background explanation of the law, clarifying its meaning so any reader can understand the specific legal concept.
  • Analyze and explain the specific risks and liabilities present, including how and why each area creates vulnerabilities for GC.
  • Give a concrete example illustrating potential risk scenarios for each legal area as they might arise for GC.

Each legal area discussion should be at least 3 paragraphs, totaling a minimum of 6 paragraphs for both areas, and must include citations from relevant sources.

Part II. Legal Counsel

Reflecting on your experience during the past eight weeks of consulting with GC, your research, and analysis, you are to make recommendations regarding legal counsel:

  • Evaluate and explain why you recommend GC seek legal counsel for all aspects of its business operations, such as contract drafting, risk management procedures, recruitment policies, etc.
  • Support your rationale with specific examples, personal insights, and detailed reasoning.
  • Discuss specific operational areas where legal advice is especially critical.

While personal opinion does not require citations, whenever you reference information from assigned course materials, include appropriate citations. Your response should be at least 3 paragraphs.

  • Use complete sentences in paragraph format, with double spacing and 12-point font (Arial or Times New Roman).
